The legal treatment of the applications of biogenetic - especially in private law sector

Abstract

Object of the thesis is the examination of the treatment of the applications of biogenetic by the legal order, especially in private law sector. Target of the study is the achievement of balance between the scientific research and knowledge for the profit of human health and the need of respect of the value of the person. In this frame it is examined which are the limits of scientific research and application of genetic technology and if the legislation in force faces effectively the dangers of scientific development and if and which legislative regulations are required. The forms of genetic testing and gene therapy, their conditions and the civil liability from their application are analysed. The possibilities and the conditions of research and more specifically the research in fertilized ova, stem cells and therapeutic cloning, the moral questions and the dangers that they emerge are also examined.
